Not sure how they got away with it, but as far as i know was not a VOSA recall, one that slipped through the net...it should have been.

When i took my old W210 into MB and pointed out it was safety critical related as failure causes catastrophic damage, my claim was quickly processed FOC, bearing in mind the car was 9 years old at the time..it was my local MB indy who pointed it out to me during servicing after i had bought the car.

Had to repair one of mine. Annoying and it was bad detail design - it shouldn't have happened.
Essentially it was a flat 'closing plate' over the drop forged cross member, so of little structural value; it held on the under-tray captive nuts.

to bad this E430 is low on power options.
if this car was previously owned by an MB guy, these dudes usually tick every options box on their new car order.

i always want my Benz to be loaded with power buttons.
i would never buy a low spec MB
